The Trøndelag District Court has ruled that the state is responsible for the health condition of a medical assistant who developed symptoms of chronic fatigue with a neurological basis after receiving the COVID-19 vaccine. The verdict has been described as historic, as it was issued despite the lack of one hundred percent confirmation of a link between the vaccination and the illness.
In its justification, the court indicated that the woman was vaccinated with the Pfizer vaccine during the pandemic, and symptoms appeared the same day. The state, represented by the Norwegian Patient Injury Compensation Board, had previously rejected her claim, arguing that no patient injury had occurred.

However, the Trøndelag District Court found that the short time between vaccination and the onset of symptoms was significant. In the court's view, there was no more probable cause than the vaccine itself. The case was described in the verdict, which was accessed by the Nettavisen editorial team.

State Responsibility

The court stated that the state had not demonstrated any other factors that could have caused the illness independently of the vaccination. The verdict emphasized that regulations regarding post-vaccination injuries are intended to protect people whose causes are not fully explained.

The state's liability for compensation results from a statutory framework that allows for it even when the actual causal link is not certain. At the same time, it was noted that the outcome of similar cases may depend on individual circumstances. The woman will receive over NOK 500,000 from the state to cover legal costs.

More Cases in Norwegian Courts

The verdict also stated that the amount of potential compensation for the chronic fatigue illness with a neurological basis has not yet been determined. The decision comes at a time when more disputes regarding COVID-19 vaccinations are ongoing in Norwegian courts.

One such case concerns a 28-year-old woman who received the AstraZeneca vaccine in March 2021. Her first symptoms, including fatigue and muscle pain, appeared a few days after vaccination. According to her lawyer, her health situation in 2025 remains the same as it was four years earlier.

A New Reference Point for Vaccination Disputes

The Trøndelag verdict may be significant for those pursuing similar cases against the state. Ongoing cases will be analyzed in light of this decision, but their outcomes will depend on individual evidence.

The court emphasized that regulations regarding post-vaccination injuries are of a special nature. Upcoming trials will show how the Norwegian legal system applies these provisions in practice.
