Mistakes That Will Make You Lose Pendler Status. How to Avoid Them?

Pendler Status in Norway MojaNorwegia

The most common mistakes and pitfalls you need to watch out for when filing your Norwegian tax return. Don’t get caught in Skatteetaten’s traps!

The commuter deduction (known as Pendler, i.e. deduction of travel, accommodation, and food expenses) is one of the most valuable but also most complicated deductions in the Norwegian tax system. This is exactly where Polish workers often make mistakes, which can end with a call for explanations, and in the worst case, loss of deductions, the need to return unjustly received money, and even penalties.

We have prepared a short and practical guide to help you avoid typical mistakes and file your taxes confidently and with maximum benefit.

Lack of Evidence for "Regular Visits" to Poland

Pendler status is based on the fact that your “center of vital interests” is in Poland. To prove this, you must return there regularly.

Mistake: thinking that simply having a wife and children in Poland automatically entitles you to the deduction.

How to avoid it? You must travel to your family in Poland at least once per quarter or meet strict requirements regarding apartment size, visits, and frequency of travel to Poland (if you are single).

Expert tip: collect plane tickets or ferry confirmations. The tax office may ask for them even 2-3 years back!

Mistakes in Documenting Housing Costs

This is where Skatteetaten most often "cuts" deductions.

Mistake: deducting housing costs when you are not entitled to the deduction (working and living in the same kommune for more than 2 years), deducting costs not paid by yourself (covered by your employer), or lack of documentation (rental agreement, transfer confirmations to the landlord).

How to avoid it? Check if you are entitled to the deduction, make accurate calculations. Remember, you must also have invoices in your name or transfer confirmations for rent and electricity. Paying "in cash" without a receipt is the easiest way to lose the deduction.

Important: if you share an apartment with someone else, only deduct your share of the costs.

The 24-Month Trap

This is one of the most painful legal changes in recent years, affecting so-called single commuters.

Mistake: assuming that the deduction for meals and accommodation lasts forever.

How to avoid it? You can only deduct housing and food costs for 24 months in a given municipality. After that time, you lose the right to these deductions, unless you change your municipality of residence and employer.

Meals: When Can You Deduct, and When Not?

Many taxpayers claim meal allowances (kost), even though they are not entitled to them.

Mistake: deducting meal allowances when your accommodation in Norway has a kitchen.

How to avoid it? Currently, to deduct meal allowances, you must prove that you cannot prepare meals yourself (e.g., you live in a hotel or barrack without access to a kitchen). If your accommodation has a fridge and stove, the deduction will most likely be rejected.

Important! If you live in a barrack, you are entitled to deduct meal allowances, even if you have access to a kitchen. Remember, you can only use this deduction if you are a pendler and only if you paid for your meals yourself (your employer did not provide free meals).

Ignoring Letters from the Tax Office (Skatteoppgjør)

Skatteetaten often sends requests for additional documentation.

Mistake: not checking your electronic (Altinn) or paper mail and hoping that "it will somehow work out."

How to avoid it? Regularly check Altinn/Skatteetaten. If the office asks for documents and you do not respond on time, your deduction will be automatically rejected, and you may be penalized with additional tax (tilleggsskatt).

The Golden Rule of Pendler

In the Norwegian tax system, the burden of proof is on you. You must prove that you incurred the costs and that you are entitled to the status.

Expert advice from MultiNOR: don’t wait until the last minute to organize your documents. Create a folder (physical or on your computer) where you put rent payment confirmations and tickets to Poland every month.

Not sure if you can file your taxes as a pendler? At MultiNOR we will check your situation and help you recover the maximum possible tax without risking an audit.
